The following is our current rental contract and we ask that you read it thoroughly before agreeing to rent as it will be used as the basis for any dispute that may arise.
THIS AGREEMENT IS A LEGALLY BINDING CONTRACT. PLEASE READ THE ENTIRE AGREEMENT CAREFULLY BEFORE SIGNING. BY EXECUTING BELOW, THE PARTIES AGREE TO THE CONTENTS DESCRIBED IN THIS DOCUMENT INCLUDING:
SECURITY DEPOSIT PROTECTION PLAN
The Tenant agrees to deposit with MAINSTAY, INC. the Security Deposit listed above. It will be returned no later than 45 days after departure, less any charges for cleaning, damage, or any other charges incurred by the TENANT.
It is agreed that Mainstay Inc. shall prepare the property for occupancy; that the TENANT shall maintain same in good order for the full term of this agreement; that the TENANT shall vacate the property peacefully and quietly at the end of the term, leaving the property in the same condition in which occupancy began and ready for the next occupant. The TENANT will be responsible for all damage or breakage and / or loss to the property except normal wear and tear during the term of this agreement.
CANCELLATION POLICY
The TENANT is responsible for full payment of this agreement. In the event of cancellation by the Tenant, and the property is re-rented under the above terms for the above rental period, a 20% cancellation fee will apply.
ARTICLES LEFT BEHIND
All personal property of the Tenant brought onto the leased Premises shall be at the sole risk of the tenant. Landlord and Rental Agent are not responsible for any personal property brought to, left at, or take from the premise. Items left behind will be returned to the tenant upon request at the cost of the tenant.
PET POLICY
Tenant shall not bring or keep any Pet of any kind on the Premises without the express written permission of the Landlord. If any pets are found on the Premises, then the entire security deposit shall be forfeited and the Rental Agent shall provide it to the Landlord, but this shall not limit the Tenant’s liability for damage or costs otherwise due hereunder. Service animals are not Pets, but proper documentation must be provided in advance.
RULES & REGULATIONS
- Tenant shall not smoke in or on the premise, allow consumption of alcohol by underage persons, use any illegal drugs or substances, allow driving by intoxicated persons from the Premises, not have any fire, fireworks, sparklers, or other combustibles (excluding candles and grills) or have any guns or dangerous weapons on the premises.
- TENANT agrees to follow all policies and procedures as instructed by MAINSTAY, INC. upon check-in.
- TENANT agrees to allow the OWNER or an agent of MAINSTAY, INC. to enter and view the property with 24 hour notice; to make repairs to property; to show property to prospective tenant or buyer; and to expel the TENANT if breach of this Agreement in any way, in accordance with the laws of the Commonwealth of Massachusetts.
- TENANT shall not sublet, nor underlet, nor permit any other person to occupy the property
- Lead Paint: Mainstay Inc.. does not know whether lead paint is present in said property.
- A tax may be imposed on short-term rental in Massachusetts and may vary based on local ordinances and bylaws as well as the OWNER’S property holdings. The premises may be subject to the following tax rates- MA State Tax 5.7% and Nantucket Local Tax 6%.
“I acknowledge and understand the policies and procedures as they are described above, also understanding that Mainstay, Inc. ultimately represents the interests of the individual property owners. Should I have any questions regarding my reservation or other company policies/procedures, I will contact Mainstay, Inc.”
